1. Acceptance of Terms
By accessing or using the Slabkast platform at slabkast.com and app.slabkast.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.
Slabkast is a product of Monolit Group Ltd, a private company registered in New Zealand (“Slabkast,” “we,” “us,” or “our”). These Terms constitute a legally binding agreement between you (“you” or “User”) and Monolit Group Ltd. By creating an account, starting a free trial, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms.
2. Description of Service
Slabkast is a cloud-based visual approval and production handoff platform designed for stone fabricators. The Service enables users to manage slab imagery, facilitate client approvals, and streamline production workflows through a web-based application.
The Service is provided as a software-as-a-service (SaaS) product accessible via modern web browsers. Slabkast does not offer a native mobile application at this time.
3. Account Registration and Responsibilities
To use the Service, you must create an account by providing your name, email address, phone number, country, business name, and a password. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@slabkast.com if you become aware of any unauthorised use of your account.
You must be at least 16 years of age to create an account and use the Service.
4. Free Trial
Slabkast offers a 7-day free trial to new users. During the trial period, you have access to all features of the Service with no restrictions. No credit card is required to start your trial.
At the end of the 7-day trial, if you have not added a valid payment method, your account will be automatically paused. You will not be charged. Your data will be retained, and you may reactivate your account at any time by adding a payment method and subscribing.
We reserve the right to modify or discontinue the free trial offer at any time without prior notice.
5. Subscription and Billing
After your free trial, continued use of the Service requires a paid subscription. Subscriptions are billed monthly. The current subscription price and available billing currencies are displayed on our website and at checkout, and depend on your location.
All payments are processed securely through Stripe, our payment processor. By subscribing, you authorise Stripe to charge your chosen payment method on a recurring monthly basis. We do not store your full payment card details.
Prices are exclusive of any applicable taxes, levies, or duties (including GST or VAT) unless stated otherwise. You are responsible for paying any such taxes associated with your subscription. We may change our prices from time to time; we will give you reasonable advance notice of any price change, and the change will take effect from your next billing period.
Subscriptions renew automatically each month. You may cancel your subscription at any time from the billing portal. Cancellation takes effect at the end of the current billing period — you will retain access until then. Except where required by law, payments are non-refundable and no refunds are provided for partial billing periods.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any illegal or unauthorised purpose.
- Upload, store, or transmit any content that you do not have the right to use, or that infringes the intellectual property, privacy, or other rights of any third party.
- Attempt to gain unauthorised access to any part of the Service, other accounts, or systems connected to the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Upload or transmit viruses, malware, or any harmful code.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Resell, sublicense, or redistribute the Service without our prior written consent.
- Use the Service in a manner that could damage, disable, or impair the Service for other users.
We reserve the right to suspend or terminate your account if we reasonably believe you are violating these acceptable use provisions.
7. Intellectual Property
The Service, including its design, code, features, documentation, branding, and all related intellectual property, is owned by Monolit Group Ltd and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it under these Terms.
You retain full ownership of any data, photos, images, and content that you upload to or create within the Service (“Your Content”). By using the Service, you grant Slabkast a limited, non-exclusive licence to host, store, process, and display Your Content as needed to provide the Service to you — including displaying Your Content to the clients and other recipients you designate for approval or collaboration.
You are solely responsible for Your Content and confirm that you have all rights and permissions necessary to upload it and to share it through the Service. We do not claim ownership of Your Content and will not use it for any purpose other than delivering the Service.
If you provide us with feedback, ideas, or suggestions about the Service, you grant us a perpetual, royalty-free right to use them without restriction or obligation to you.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.
You are responsible for maintaining your own backups of Your Content. While we take reasonable measures to protect and retain data, we do not guarantee against loss, and you should keep independent copies of any content that is important to you.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Slabkast and Monolit Group Ltd, and their officers, directors, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service.
Our total aggregate liability for any and all claims arising under or in connection with these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will not be lost.
Slabkast is a platform tool that assists with slab layout, visualization, and client approval. Slabkast does not guarantee the accuracy of calibration outputs, exported DXF files, or any fabrication result. You are solely responsible for verifying all measurements, layouts, and cut files before fabrication. Slabkast shall not be liable for any material waste, rework, damage, or loss arising from inaccuracies in exported files, errors in layout or vein matching, CNC machine behavior, or any other fabrication outcome. The final responsibility for verifying and approving all production files rests with you and your team.
Slabkast’s image rectification — the process of matching the corrected (flattened) slab image to the original photograph — operates within a tolerance of up to 0.2% (approximately 99.8% matching accuracy). Because of this, exported layouts and cut files may deviate from the physical slab by up to 0.2%, and a corresponding deviation may occur when cutting. You must allow for this tolerance and verify all measurements and cut files against the physical slab before fabrication.
10. Business Use and Consumer Guarantees
The Service is provided for business and commercial purposes only. You acquire and use the Service solely for the purposes of a business and not as a consumer.
Accordingly, to the maximum extent permitted by law, the guarantees, warranties, and protections under the New Zealand Consumer Guarantees Act 1993 and the Fair Trading Act 1986, the Australian Consumer Law, and any equivalent consumer protection legislation in other jurisdictions do not apply to your use of the Service. Where such legislation cannot lawfully be excluded, our liability is limited to the maximum extent permitted by that legislation (for example, at our option, resupplying the Service or paying the cost of having it resupplied).
11. Indemnification
You agree to indemnify, defend, and hold harmless Slabkast, Monolit Group Ltd, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use or misuse of the Service; (c) your breach of these Terms; (d) your violation of any law or of the rights of any third party; or (e) any fabrication, cutting, or production decision you make using the Service.
12. Termination
You may terminate your account at any time by cancelling your subscription and contacting us at support@slabkast.com to request account deletion.
We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent or abusive behaviour, or if we are required to do so by law. We may also terminate the Service entirely with reasonable notice.
Upon termination, your right to use the Service ceases immediately. Your data will be handled in accordance with our Privacy Policy, including our data retention schedule.
Any provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
13. General Provisions
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- No waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, for example in connection with a merger, acquisition, or sale of assets.
- Force majeure: We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, outages, network or hosting failures, acts of government, or other force majeure events.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict-of-law principles. You agree that the courts of New Zealand have exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms or the Service, and you submit to the jurisdiction of those courts.
15. Changes to Terms
We may update these Terms from time to time. We will post the revised version with an updated effective date at the top of this page, and where changes are material, we will take reasonable steps to notify you (for example, by email or a notice within the Service).
Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you should stop using the Service and cancel your account.
